What is an Owners Corporation?

Understanding Owners Corporations in Victoria

An Owners Corporation (formerly known as a 'body corporate') manages the common property of a residential, commercial, retail, industrial, or mixed-use property development. All bodies corporate officially became Owners Corporations on 31 December 2007, following the commencement of the Victorian Owners Corporations Act 2006, which sets out the statutory duties, powers, and governance obligations for properties across Victoria.

How an Owners Corporation is Formed

An Owners Corporation is automatically created when a plan of subdivision containing common property is registered with Land Use Victoria. The plan defines:

  • Lots: Parcels of land or units that can be bought and sold separately.
  • Common Property: Shared spaces and structures such as driveways, gardens, passages, external walls, pathways, lifts, foyers, and boundary fences.

A plan of subdivision can contain multiple Owners Corporations depending on the complexity of the development (e.g., unlimited main OCs paired with limited residential or commercial OCs).

Rights & Legal Responsibilities for Lot Owners

Anyone who purchases a lot tied to an Owners Corporation automatically becomes a member. Membership carries ongoing legal, administrative, and financial responsibilities—including contributing to maintenance levies, adhering to registered rules, and maintaining insurance standards.

At Bellarine and Surf Coast Strata, we assist committees across Geelong, the Bellarine Peninsula, and the Surf Coast in navigating these statutory requirements smoothly and transparently.

What to Check Before Buying a Property Managed by an Owners Corporation

Purchasing an apartment, townhouse, or commercial unit in Victoria means buying into an Owners Corporation. Before finalizing a contract, it is vital to thoroughly review the property's administrative and financial health.

1. Inspect the Owners Corporation Certificate

Under Section 32 of the Sale of Land Act 1962, the vendor is legally required to include an Owners Corporation Certificate within the vendor statement. This document provides critical insights into the scheme, including:

  • Annual Fees & Levies: Current quarterly fees and any pending special levies.
  • Lot Liability & Entitlement: Your proportional voting rights and contribution share for ongoing expenses.
  • Financial Status & Funds: Balance of the administrative and maintenance (sinking) funds.
  • Insurance Coverage: Current building and public liability insurance details.
  • Legal Liabilities & Disputes: Unsettled building defects, active legal proceedings, or unpaid repairs.

2. Review the Owners Corporation Register & Rules

Prospective buyers should also inspect the official register to review additional restrictions, easements, covenants, or customized special rules (such as pet policies, short-stay restrictions, or renovation guidelines).

Note for Buyers & Vendors: While the seller must ensure an up-to-date certificate is included in the Section 32, buyers can also request or purchase an updated certificate directly from the appointed Owners Corporation manager.
